IN ANY EVENT, PEQUOD'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE AND SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PEQUOD'S PIZZA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The limitations set forth in this section shall apply regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or otherwise, even if Pequod's Pizza has been advised of the possibility of such damages.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza, its affiliates, subsidiaries, parent companies, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
